Registration

You are solely responsible for maintaining the secrecy and confidentiality of your username and password. You acknowledge and agree that anyone who obtains your username and password may access the website in the same manner as you would. You will be responsible for all activities conducted under your account.

Toughees Telecom, its employees, or associates shall not be held responsible for losses arising from the unauthorised sharing, disclosure, or misuse of your login credentials, except where liability cannot be excluded under applicable law.

You agree that your purpose of registering or using the website is to purchase products or avail services offered by Toughees Telecom, including smartphones, tablets, laptops, electronic gadgets, accessories, and related services, as permitted under applicable laws.

You agree to provide true, accurate, and complete information while registering or whenever requested on the website. You must not misrepresent your identity, impersonate another user, or register or log in using another person's identity without authorisation.

You are responsible for maintaining and promptly updating your registration details to ensure that all information remains accurate, current, and complete.

If you provide information that is false, inaccurate, outdated, or incomplete, or if Toughees Telecom has reasonable grounds to believe that you have violated this User Agreement, we reserve the right to suspend, restrict, or terminate your account or access to the website, subject to applicable laws.

No Compensation Policy

If the quality, specifications, performance, or other characteristics of any product or service purchased through the Toughees Telecom website do not meet your expectations, any available remedy shall be governed by our applicable Cancellation, Return & Refund Policy, manufacturer warranty terms, and applicable consumer protection laws.

Customers shall not be entitled to additional compensation for circumstances including, but not limited to:

Variations in product appearance, finish, or packaging that do not affect the product's essential specifications or functionality.
Delivery delays caused by unforeseen circumstances or logistics partners.
Missed opportunities to avail discounts or promotional offers.
Unavailability of products after an order has been placed.
Expired, deactivated, or invalid promotional vouchers.
Delays or service-related issues caused by third-party delivery partners.
Indirect or consequential losses, except where compensation is required under applicable law.

Toughees Telecom reserves the right to review and reject unreasonable or fraudulent compensation requests. We may also cancel orders or restrict accounts involved in fraudulent activities, misuse of promotional offers, or repeated violations of our policies, in accordance with applicable laws.

Loss to Business / Misuse of Services

A customer account may be flagged for review if any of the following situations occur:

Repeated order cancellations or unusually high return or claim rates.
Providing invalid or incomplete delivery addresses.
Repeated refusal to accept confirmed deliveries without a valid reason.
Repeated requests for unreasonable monetary compensation.
Suspected fraudulent transactions or misuse of promotional offers.
Activities that cause deliberate financial or operational losses to the business.

Toughees Telecom reserves the right to investigate such cases and may suspend or restrict accounts found to be involved in fraudulent or abusive activities.

Any promotional credits, referral benefits, or loyalty rewards obtained through fraudulent means may be cancelled or forfeited, subject to applicable terms and laws.

Prohibited Activities

All users accessing Toughees Telecom's website or services must comply with applicable laws and regulations.

You agree not to engage in any activity that:

Provides false, inaccurate, misleading, or fraudulent information.
Is offensive, abusive, threatening, defamatory, obscene, or unlawful.
Violates any third party's copyright, trademark, patent, trade secret, privacy, or other intellectual property rights.
Involves the purchase, sale, or promotion of counterfeit, stolen, or illegally obtained products.
Violates applicable consumer protection, competition, advertising, data protection, or other legal requirements.
Contains viruses, malware, Trojan horses, worms, or other harmful code intended to disrupt or damage computer systems or website operations.
Attempts to gain unauthorised access to the website, its servers, databases, or user accounts.
Disrupts, damages, or interferes with the normal functioning of the website or its services.
Uses robots, spiders, scrapers, bots, or other automated tools to access or collect information from the website without prior written permission.
Impersonates Toughees Telecom employees, representatives, other customers, or any third party.
Creates fake accounts or misrepresents any affiliation with another individual or organisation.
Harasses, threatens, or intimidates other users or Toughees Telecom employees.

Toughees Telecom reserves the right to restrict access, suspend accounts, or take appropriate legal action against users involved in prohibited activities, as permitted under applicable laws.

Arbitration

In the event of any dispute between you and Toughees Telecom arising out of your use of the website, purchase of products, availing of services, or any matter relating to this User Agreement, the parties shall make reasonable efforts to resolve the matter amicably.

If the dispute cannot be resolved amicably, it may be referred to arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.

The arbitration shall be conducted by a mutually appointed sole arbitrator in accordance with applicable law. The seat and venue of arbitration shall be Delhi, India, and the proceedings shall be conducted in English.

Nothing in this clause shall restrict any consumer's statutory right to approach the appropriate consumer forum or authority under applicable Indian law.

Governing Law and Jurisdiction

This User Agreement and all policies, terms, and documents incorporated herein shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable consumer protection laws and statutory jurisdiction, courts in Delhi, India, shall have jurisdiction over disputes arising from this agreement.

This document constitutes an electronic record under the Information Technology Act, 2000, and the applicable rules and amendments thereunder. Being an electronic record generated by a computer system, it does not require a physical or digital signature unless otherwise required by applicable law.

Warranty

Products sold by Toughees Telecom may carry a manufacturer's warranty, depending on the product, brand, and applicable warranty terms.

All warranty coverage, including its duration, scope, exclusions, repairs, replacements, and service conditions, shall be governed by the respective Original Equipment Manufacturer (OEM).

Toughees Telecom does not independently provide or control OEM warranty services and shall not be responsible for the decisions, service quality, repair timelines, or policies of authorised manufacturer service centres, except where responsibility is imposed by applicable law.

For warranty-related issues, customers may be required to contact the respective brand's authorised service centre directly along with the purchase invoice.

Toughees Telecom will provide reasonable assistance with purchase documentation wherever required. After-sales warranty services, repairs, and replacements shall be handled in accordance with the manufacturer's applicable warranty terms and conditions.

For repair services independently provided by Toughees Telecom, applicable service charges, repair warranties, and service conditions will be communicated separately.
